4. Basic information on the life situation
An authority for registering a birth is a registry office in whose administrative district an individual was born.
(The administrative district of the registry office of ÚMČ města Brna, Brno-střed (Brno City District Office, Brno-Centre) includes the following Brno City districts: Brno-střed (Brno Centre), Kohoutovice, Bohunice, Starý Lískovec, Nový Lískovec and Bosonohy.)
Registration in the book of births is made on the basis of a written notification by the medical facility regarding the birth of a child, or on the basis of an oral notification of a birth outside the medical facility, if the mother was not provided medical care even after the birth.

6. Conditions and procedures regarding this life situation
If the child is born in a maternity hospital (FN Brno, Obilní trh; FN Brno, Bohunice; NMB Brno, Polní), the registry office will receive the “Notification of the birth of a child” from the hospital, on the basis of which the child is registered in the book of births and the child’s birth certificate is issued. The birth certificate is usually ready for collection on the 10-th day after the birth of the child. If you need to collect the birth certificate at an earlier date, ask the registry office directly about this possibility.

10. Documents to bring with you
Unless the mother had the below documents with her in the hospital, the following documents shall be submitted for the issuance of the birth certificate:
- A consonant declaration of both parents about the child’s name, which the mother signs in the hospital. The father signs the statement about the child’s name on receipt of the birth certificate at the registry office (if the father cannot appear in person, it is necessary to deliver a written father’s consent with the child’s name)
- For children born during the marriage - a marriage certificate of the parents
- For children born outside marriage
* to an unmarried mother - a birth certificate
* to a divorced mother - a birth certificate, a final judgement of divorce
* to a widowed mother - a birth certificate, a death certificate of the husband * a mother-foreigner shall also submit with the above documents an up-to-date confirmation of her marital status issued by the competent authorities of her home state
* a protocol on the determination of paternity of an unborn child, if applicable
* if the child was born from in vitro fertilization, a written consent of the man who gave permission for in vitro fertilization confirmed by the provider of the health service, and a consonant declaration of both parents regarding the name(s) and surname of the child.

All submitted foreign documents shall be always submitted in the original or in an officially certified photocopy, bear all required verifications and be officially translated into the Czech language.
This means that the relevant documents should be verified by higher authorities of the relevant state and subsequently further verified (“superlegalized”) by the Czech embassy in that particular state. If the documents are issued by the embassy of a foreign state in the Czech Republic, they shall be verified by the Ministry of Foreign Affairs of the Czech Republic in Prague. According to an international convention, it is possible to substitute the “superlegalization” of documents by a verification clause, the so-called “APOSTILLE”. This verification is not necessary if the document was issued in a country with which the Czech Republic has an agreement on legal assistance in civil and family matters. All submitted foreign documents shall not only bear the relevant verifications (see above), but also be translated into the Czech language by a court interpreter appointed by the decree of a competent court according to Act No. 36/1967 Coll. on experts and interpreters, as amended. If such documents are translated into the Czech language abroad, they need to be verified by our embassy in the country where the translation is made.

The applicant for the registration of a birth may appeal against the decision not to register within 15 days of the receipt of this decision; the appeal is made to Odbor vnitřních věcí Magistrátu města Brna (Department of Internal Affairs of the Brno City Municipality), Malinovského nám. 3, Brno, through the filing room (podatelna) of ÚMČ města Brna (Brno City District Office), Brno-střed (Brno-Centre), Dominikánská 2, Brno.

If the child is born before the three-hundredth day lapses after the dissolution of marriage (by divorce and/or after the mother’s husband dies or is declared missing), the child’s mother shall submit a marriage certificate and the child’s surname is registered according to the agreement about the surname on the marriage certificate, and the former husband of the mother is registered as the child’s father, unless the mother has entered into a new marriage before the child’s birth. A divorced mother shall also submit an agreement with the child’s name from the former spouse.

If the parents are not married and the mother did not give birth within three hundred days from the dissolution of marriage, the parents can determine the paternity of the child.
